These disclosures apply
if you have contracted for one or more of the following USF
Federal Credit Union electronic services:
- An automated teller
machine card (ATM)
- VISA Check Card
- Money-Line (Audio
Response)
- cyberteller
(Home Banking)
- The direct deposit
into checking or savings of periodic payments from persons
other than the Credit Union
- A preauthorized
periodic deduction from your checking account to a third
party (other than the Credit Union) such as a loan payment
to another financial institution or an insurance payment.
Disclosure of
Terms and Conditions of ATM/VISA Check Card Use
Use by you or anyone authorized by you of the ATM/VISA Check
Card to obtain cash, goods or services at any authorized terminal
may be charged to your checking account and treated as if
it were a "check" pursuant to these agreements:
The
Credit Union may charge withdrawals to the checking account
in any order it determines and if funds are not sufficient
to cover all withdrawals may dishonor regular checks.
The
credit union cannot honor stop payment requests on ATM/VISA
Check Card withdrawals.
You
are liable for any overdrafts caused by the use of the card.
Even
though your account may have a sufficient balance to cover
the requested withdrawal, the ATM or merchant where the card
is used may not honor the card or the transaction. In this
event the Credit Union will have no liability for refusal
to honor the card, complete the transaction or retention of
the card.
Even
though your monthly statement will identify the ATM or merchant
at which you used your card, you should retain the receipt
furnished at the time to verify with the statement. In the
event the slips are lost and you request verification for
the transactions, the Credit Union may make reasonable charges
for verification of unauthorized or fraudulent use of the
card provided you have notified the Credit Union of the card's
loss or theft as required by these disclosures.
VISA
Check Card merchant transactions are authorized on the available
balance in your checking account and may be covered by overdraft
protection from your share savings account.
You
will not use your ATM/VISA Check Card to overdraw your checking
account. However, if you do overdraw, you authorize the Credit
Union to cover the overdraft by withdrawing funds from your
share savings account or by making a withdrawal from other
share accounts on which you are a joint owner. If no funds
are available, you will repay upon demand any overdraft, in
addition to reasonable attorney and credit Union charges incurred.
Due to the nature of the travel industry, the ATM/VISA Check
Card is not recommended for use in securing hotel or auto
rental reservations.
Termination
of Service
The ATM/VISA Check Card is the property of the Credit Union
and will be delivered to the Credit Union immediately upon
oral or written request. You may cancel this agreement at
any time by notifying the Credit Union in writing. In that
event, all rights and obligations for any transaction(s) that
occurs before the Credit Union receives notice of cancellation
shall be determined by this agreement.
Consumer's Liability
for Unauthorized Transfers and Advisability of Prompt Reporting
Any code issued to you is confidential and should not be disclosed
to third parties or recorded on or with your ATM/VISA Check
Card. You are responsible for safekeeping your access code
to any of your electronic services including Money-Line and
cyberteller. You agree not to disclose or otherwise
make your access code available to anyone not authorized to
sign on your accounts. If you fail to maintain the security
of this access code and the Credit Union suffers a loss, we
may terminate your services immediately.
The limit to your liability for the unauthorized use of your
ATM/VISA Check Card may be determined by how it is misused.
If the merchant swiped your card and required
a signature, you will NOT be liable for the unauthorized
use that occurs after you notify the Credit union orally or
in writing, of the loss, theft, or possible unauthorized use.
In any case, your liability will NOT exceed $50.
If your card was used at a terminal that required
the use of an access code or personal identification number,
you must tell us AT ONCE if you believe your ATM/VISA
Check Card access code or card has been lost, stolen or compromised.
Telephoning is the best way of keeping your possible losses
down. You could lose all of the money in your account (plus
your maximum overdraft line of credit). If you tell us within
two (2) business days, you can lose no more than $50 if someone
used your ATM/VISA Check Card or access code without your
permission.
If you do NOT tell us within two (2)
business days after you learn of the loss or theft of your
ATM/VISA Check Card or access code, and we can prove we could
have stopped someone from using your ATM/VISA Check Card or
access code without your permission if you had told us, you
could lose as much as $500.
Also, if your statement shows transfers that
you did not make, tell us at once. If you do not tell us within
60 days after the statement was mailed to you, you may not
get back any money you lost after the 60 days if we can prove
that we could have stopped someone from taking the money if
you had told us in time. If a good reason (such as a long
trip or hospital stay) kept you from telling us, we may extend
the time periods.

If you believe your ATM/VISA Check Card or your access code
to any card, Money-Line or cyberteller has been lost or stolen
or that someone has transferred or may transfer money from
your account without your permission, call us at (813)

Definition of
Business Days
Each day is a business day with the exception of Saturday,
Sunday and Holidays.
Types of Available
Transfers
You may use your ATM/VISA Check Card to:
Withdraw
cash from your checking or regular savings.
Make
deposits to your checking or regular savings where this service
is available.
Transfer
funds between your checking and savings accounts whenever
you request.
Pay
for purchases at places that have agreed to accept the ATM/VISA
Check Card.
Limitation of
Frequency and Dollar Amount of Transfers
You
may withdraw up to $200 in any day from ATMs and purchase
up to $750 through Point-of-Sale terminals, subject to the
available balance in your account and ATM network access.
Your ATM withdrawal limit may be approved up to $500. When
there are network-to-host communication problems, you may
be limited to $200, even if your daily limit is higher. Not
all services are available and the dollar limit may be different
at some ATMs.
For
security reasons, there may be other limits on the number
and dollar amounts on point-of-sale terminals and limits on
the number of daily purchases using your ATM/VISA Check Card.
Charges for
Transfers
Service charges are published in the USF Federal Credit Union
schedule for fees available at any of our offices, from our
website at www.usffcu.org or upon request.
Disclosure of
Account Information to Third Parties
We will disclose information to third parties about your account
or the transfers you make:
Where
it is necessary for completing transfers
In order
to verify the existence and condition of your account for
a third party, such as a credit bureau or merchant
In order
to comply with a government agency or court orders
If you
give us your written permission
Right to Receive
Documentation
TERMINAL
TRANSFERS: You can get a receipt at the time you make any
transfer to or from your account using an ATM or point-of-sale
terminal.
PREAUTHORIZED
CREDITS: If you have arranged to have direct deposits made
to your account at least once every 60 days from the same
person or company making the deposit they will tell you every
time they send us the money. You may use the Money-Line or
cyberteller to find out whether or not the deposit has been
made or you may phone us at 813-569-2000 ext. 7.
PERIODIC
STATEMENTS: You will get a monthly account statement unless
there are no transfers in a particular month. In any case
you will get the statement at least quarterly.
Procedures for
Stopping Preauthorized Payments
If you have told us in advance to make regular payments out
of your account, you can stop any of these payments by calling
us at 813-569-2000 ext. 7, or write to, Lobby Services
at 13302 USF Palm Drive, Tampa, Florida 33612 or e-mail us
at member_services@usffcu.org in time for us to receive your
request three (3) business days or more before the payment
is scheduled to be made. If you call, we may also require
you to put your request in writing and get it to us within
14 days after you call. A service fee may be assessed for
each stop payment you ask us to place. Please check the USF
Federal Credit union schedule of fees for the exact amount
you will be charged or visit our website
at www.usffcu.org.
Notice of Varying
Amounts of Preauthorized Payments
If these periodic payments may vary in amount, the person
you are going to pay will tell you at least 10 days before
each payment when it will be made and how much it will be.
Alternatively, the person you are going to pay may allow you
to choose instead to get this notice only when the payment
would differ by more than a certain amount from the previous
payment, or when the amount would fall outside certain limits
that you set.
Liability for
Failure to Stop Payment for Preauthorized Payments
If you order us to stop one of these payments three (3) business
days or more before the payment is scheduled to be made, and
we do not do so, we will be liable for your losses or damages.
Financial Institution's
Liability for Failure to Make Payments
if we do not complete a transfer to or from your account on
time or in the correct amount according to our agreement with
you, we will normally be liable for your losses or damages.
However, there are some exceptions. We will NOT be liable,
for instance:
If through no fault of ours, you DO NOT have enough money
in your account to make the transfer.
If the
transfer would go over the credit limit on your overdraft
line of credit.
If the
ATM where you are making the transfer does not have enough
cash.
If the
ATM was not working properly and you knew about the malfunction
when you started the transfer.
If circumstances
beyond our control such as fire or flood prevent the transfer,
despite reasonable precautions that we have taken.
Your
overdraft line of credit may not be accessible due to an outstanding
personal loan balance or an adverse loan condition.
In Case of Errors
or Questions about Your Electronic Transfers
Telephone us, write us or e-mail us as soon as you can, if
you think your statement or receipt is wrong or if you need
more information about a transfer listed on the statement
or receipt.

We must hear from you no later than 60 days
after we sent the FIRST statement on which the problem or
error appeared.
Tell us your name and account number.
Describe
the error or the transfer you are unsure about, and explain
as clearly as you can why you believe it is an error or why
you need more information.
Tell
us the dollar amount of the suspected error.
If you tell us orally, we require that you
send us your complaint or question in writing within 10 business
days. We will tell you the result of our investigation within
10 business days (or 20 business days for foreign-initiated
transactions and all transfers resulting from point-of-sale
debit card transactions) after we hear from you and will correct
any error promptly. If we need more time, however, we may
take up to 45 days (or 90 business days for foreign-initiated
transactions and all transfers resulting from point-of-sale
debit card transactions) to investigate your complaint or
question. If we decide to do this, we will recredit your account
within 10 business days (or 20 business days for foreign-initiated
transactions and all transfers resulting from point-of-sale
debit card transactions) for the amount you think is in error
so that you will have the use of the money during the time
it takes us to complete our investigation. If we ask you to
put your complaint or question in writing and we do not receive
it within 10 business days (or 20 business days for foreign-initiated
transactions and all transfers resulting from point-of-sale
debit card transactions), we may not recredit your account.
If we decide there was no error, we will send
you a written explanation within three (3) business days after
we finish our investigation. You may ask for copies of the
documents we used in our investigation, however we may impose
a fee to recover our expense.
Notice Regarding
ATM Fees By Others
If you use an automated teller machine that is not operated
by us, you may be charged a fee by the operator of the machine
and/or by an automated transfer network.
YOUR ABILITY
TO WITHDRAW FUNDS AT USF FEDERAL CREDIT UNION
Our policy is to make at least a portion of the funds from
your deposits into any credit union account available to you
on the same day as we receive your deposit. At that time,
you can withdraw these funds in cash and we will use these
funds to pay checks that you have written.
In some cases, we will not make all the funds
from your deposit available to you immediately. Depending
on the type of check you deposit, funds may be held in your
account until the second or fifth business day of your deposit.
However, the first $100 of each check deposited will be made
available to you immediately.
Determining the Availability
of a Deposit
the length of the delay is counted in business days from the
day of your deposit. Each day is a business day with the exception
of Saturday, Sunday and holidays. If you make a deposit before
closing on a business day, your deposit will be credited the
same day. In the event your deposit does require a hold, we
will notify you at the time of your deposit. We will also
tell you when the funds will be available. Deposits placed
in the night depository after 9:00 a.m. will be credited the
following business day. Deposits made through an ATM will
be available the second business day with the exception of
the first $100 of your ATM deposit. In the event an item placed
in the night depository or ATM requires an additional hold,
we will mail you notification the next business day.
Longer Delays
May Apply
Funds you deposit by check may be delayed. These delays may
be as long as seven days (local items) or eleven days (non-local
items). These exceptions would apply under the following circumstances:
The USF Federal Credit Union has reason to believe a check
you have deposited will not be paid.
Your
deposits total more than $5,000 (on any one day).
You
have repeated NSF checks presented against your account.
You
redeposit a check that has been returned unpaid.
There
is an emergency, such as computer failure.
Special Rules
for New Accounts
The following rules will apply during the first 30 days your
account is open:
The first $5,000 from the deposit of a Cashier's, Teller's
or Certified Check, Traveler's Check, U.S. Treasury Check,
state and local government check will be available immediately.
The
amount of your deposit over $5,000 may be subject to an eleven
business day hold.
Funds
from all other check deposits may be subject to a two, five,
seven or eleven day hold.
Any
deposited item must be made payable to you and deposited into
your account.
Large Cash Withdrawal
Cash withdrawals greater than $10,000 may require a minimum
of 48 hours advance notice.
Joint Accounts
If any of your accounts accessed under your Membership Agreement
are joint accounts, all joint owners, including any authorized
users, shall be bound by this Agreement and, alone and together,
shall be responsible for all transactions to or from any share,
share draft or loan accounts as provided in this Agreement.
Each joint owner, without the consent of any other account
owner may, and hereby is authorized by every other joint account
owner to make any transaction permitted under this Agreement.
Each joint account owner is authorized to act for the other
account owners, and the Credit Union may accept orders and
instructions regarding any transaction on any account from
any joint account owner or authorized user.
